Why you need an up-to-date will

Have you been putting off writing or updating your will? You're not alone.

In fact, around two-thirds of people in the UK are in the same boat. But it's not somewhere you want to stay for long. Because if you die without a will, the law will decide how your property and assets are distributed.

In legal terms this is known as "dying intestate". In a moment, we'll look at this in more detail. It's important you understand how the intestacy rules work and what they could mean for your family's inheritance.

Don't get caught out
If you're married and made a will before you got married, there's something you may not realise: Your will is no longer valid.

Any time you marry or enter into a civil partnership, your marriage automatically revokes your will. Unless you make a new will, that puts you at risk of dying intestate.

But whatever your marital status and whenever you wrote your will, it's important to make sure you keep it up to date. As your circumstances and wishes change, so should your will.

We recommend you review your will every 3 years or so. Or whenever your wishes or personal circumstances change.

What are the rules of intestacy?

If you die without a will, the law will determine how your assets and property are distributed. These laws are known as the "Intestacy Rules". There are two key things you should know about the Intestacy Rules:

You may be wondering whether you need professional help to write your will. And it's true, you could write your will yourself. There are plenty of shops that sell templates and proformas. But before you go down that route, consider this:

When buying a house, would you do your own conveyancing?

Would you be confident that you would get the law 100% right? Would you be certain you understood the consequences of all the conditions and clauses in the contract for sale, title deeds, and other legal documents? If you wouldn't take the risk with your conveyancing, why would you take the risk with your will?

For most people, purchasing property is one of the most important financial decisions they make during their lifetime. Some people live to regret moving home. But they at least have the possibility of doing something about it.

With a will, there are no second chances.
